Terms and Conditions

Reading these terms and conditions accepts them.

1. Coordination and Confirmation of Shooting
Each shoot will be coordinated in advance by email and/or messaging via WhatsApp/SMS, leaving a written record of all the agreed details. This will include, but is not limited to, the budget, the date, the place or places, as well as any special conditions or specific requirements.
Written confirmation will be essential to consider the shoot as scheduled and confirmed. The Client and Schreiterer Studio agree to maintain clear and effective communication to ensure that all parties are aware of and agree to the details of the shoot.

2. Purpose of the Session
The photography session aims to create high-quality images in collaboration with the Client. The Photographer undertakes to work with sensitivity and respect towards the preferences and needs of the Client.

3. Control of the Photographer
The Photographer will have creative control over the selection of final photographs and the digital retouching process. The Client understands that the Photographer is a professional with experience in editing and retouching, and trusts his judgment to carry out this process appropriately.

4. Digital Retouching
The Photographer undertakes to retouch the images in a professional and respectful manner. If the Client has any specific preferences regarding touch-up, they are encouraged to discuss them prior to the session. The Photographer will make every effort to accommodate these preferences, but the final decision on retouching will remain with the Photographer.

5. Property Rights
The Photographer retains all copyright and intellectual property rights to the images resulting from the session. The Client has the right to use the images for personal, non-commercial purposes, such as social networks and personal albums. Any form of redistribution or commercial use is prohibited without the express written consent of the Photographer.

6. Privacy and Consent
The Client agrees that the images resulting from the session may be used for promotional purposes by the Photographer, always respecting the Client’s privacy. If the Client prefers to maintain his privacy, he must notify the Photographer in writing.

7. Limitation of Liability
The Photographer is not responsible for any damage, loss or inconvenience that may arise as a direct or indirect result of the photography session.

8. Global and Enduring Application
All terms and conditions set forth herein are applicable worldwide, without geographical limitation, unless previously agreed otherwise in writing. Furthermore, these terms and conditions have no expiration date and will remain valid and binding on all parties, regardless of geographic location or the passage of time.

9. Acceptance of Terms
The Client acknowledges that he has read, understood and accepted these Terms and Conditions prior to the photography session.

10. Customer Consent and Comfort
The Photographer is committed to creating a comfortable and respectful environment throughout the session. If at any time the Client feels uncomfortable or wishes to interrupt the session, her decision will be respected and the photographic activity will stop.

11. Confidentiality and Use in the Portfolio
The Photographer may make responsible use for professional and personal purposes of his photo retouching portfolio, including before and after images, to show examples of his skills in the use of Photoshop on his website and other promotional channels. Any information provided by the client in relation to the image retouching process may be used for the purpose of demonstrating the quality and diversity of the Photographer’s services, unless the Client previously expresses and in writing, via email, their I wish not to allow the publication of their unretouched images on the Photographer’s website or in any other media. Personal details and retouching preferences will remain confidential and will not be shared with third parties without the express consent of the Client.

12. Responsible Use of Images
The Client agrees to use the images resulting from the session in a responsible and respectful manner. The use of images for defamatory, offensive, illegal purposes or that in any way may cause harm to third parties is prohibited.

13. Claims and Adjustments
The Photographer will endeavor to meet the Client’s expectations regarding the result of the session and retouching. However, any request for adjustments or changes to images must be submitted within [number of days] days of delivery. The Photographer reserves the right to decide if the requested adjustments align with her style and artistic vision.

14. Termination of Collaboration
Both the Photographer and the Client have the right to end the collaboration at any time if they consider that the agreed terms are not being met or if an irreconcilable conflict arises. In case of termination, both parties agree to respect the images and the work done up to that moment.

15. Medical Disclaimer
The Client acknowledges that the Photographer is not a medical professional and is not qualified to render medical opinions on the Client’s aesthetic operations. Any discussion of medical procedures should take place with a qualified healthcare professional.

16. Disclaimer
The Client acknowledges and agrees that the Photographer shall not be liable for any damages, losses, injuries or claims arising out of the photography session, the retouching process or the use of the resulting images. Client expressly releases Photographer, its employees, contractors, representatives and affiliates from any liability and waives any right to bring lawsuits, legal actions or claims in connection with such events.

17. Delivery Term and Image Access Policy
The Photographer undertakes to deliver the retouched images in JPEG format and high resolution within a period of up to 7 business days from the date of the session. The images will be provided via a Dropbox link that will be sent to the email provided by the Client.
Once the link to the images is delivered, the Client will have a period of 10 calendar days to download and save the images from the Dropbox link. After this period, the link and images will be removed from Dropbox. If the Client needs to access the images again after this period, an additional charge of $100 will apply for the resubmission of the material. The Photographer is not responsible for the loss of the images if the Client does not download them within the specified period.

18. Restriction of Capture of Images during the Session
During filming and photography, anyone other than the Photographer and those authorized by Schreiterer Studio are strictly prohibited from taking photography, filming or recording in any way with mobile phones, cameras or other devices. This restriction is for the purpose of ensuring the quality and privacy of the imaging process.
Any violation of this restriction may result in session termination and legal action if necessary. All parties involved are requested to abide by this policy and allow the Photographer to carry out their work effectively and without distraction.

19. Ownership of Photographs and Videos in RAW Format
All photographs and videos captured during the session, in their RAW format, are the exclusive property of the Photographer, unless otherwise explicitly agreed and an additional quote is established. Access and availability of RAW format images are considered additional services and will be subject to a written agreement between the Photographer and the Client.
Any use, distribution or modification of the photographs and videos in RAW format without the prior written authorization of the Photographer is strictly prohibited.

20. Payment and Scheduling of the Shooting Date
To confirm and schedule a shooting date, an advance payment of 50% of the agreed budget is required. This payment must be made in accordance with the instructions provided by Schreiterer Studio. The shooting date will only be considered confirmed after receiving this payment.
The agreed budget for the session will be communicated by email or text message and must be accepted by the Client before proceeding with the payment. Any budget adjustments must be agreed upon by both parties and documented in writing prior to the shooting date.
The remaining 50% of the budget will be paid in full the day of the shoot before the session begins. The Photographer reserves the right not to start the session if the final payment is not made in accordance with this clause.

21. Additional Services of Make-up Artist, Hairdresser and Model
Make-up artist, hairdresser and model services are not included in the base budget and are quoted separately. The Client has the option of adding these services to the shooting session, and the corresponding costs will be communicated in writing via email or text message.
Any adjustment in the price of these additional services must be agreed by both parties and documented in writing before the shooting date.
Payment for make-up artist, hairdresser and model services must be made in accordance with the instructions provided by Schreiterer Studio and will be considered confirmed once the corresponding payment is received.

22. Implicit Acceptance of Terms and Conditions
Once the shooting date has been scheduled and the attached terms and conditions have been sent, it will be understood that the Client has fully accepted the terms and conditions established herein. The scheduling of the shooting date and the sending of the terms and conditions will serve as confirmation of acceptance by the Client.

23. Participation of Minors
For the participation of minors in photography sessions, the authorization and presence of parents or legal guardians will be required. The Photographer will not carry out any session that involves a minor without the proper written authorization of the parents or guardians.
The Photographer reserves the right to request a copy of the authorization signed by the parents or guardians before the session. The presence of parents or legal guardians during the session will be required at all times.

24. Additional Cost for High Resolution Photos and Basic Retouching
The Client has the option of purchasing high resolution photos with basic retouching in Photoshop for an additional cost of $150 per photo. These photos will be available as an additional service and must be requested in writing to the Photographer.
The minimum and maximum number of photos available for this option will be previously determined between the Photographer and the Client and will be agreed in writing before the shooting session.
The corresponding payment for high resolution photos and basic retouching must be made according to the instructions provided by Schreiterer Studio.
To facilitate the selection of the images, the Client will be provided with a contact sheet with the individual photos in a size of 1024×640 pixels. These photos will have a watermark to prevent their use in any medium and are strictly for the Client to choose the extra photo to retouch.
The contact sheet will be sent to the Customer via a Dropbox link. The Client will have a period of 72 hours from the sending of the link to select the additional images for the high resolution and basic retouching service.

25. Rescheduling and Cancellation due to Client Illness or Impossibility
In the event that the Client presents an illness or circumstances that prevent him from attending the shooting on the scheduled date, Schreiterer Studio will be required to be notified as far in advance as possible. The shooting may be rescheduled for an alternative date by mutual agreement between the Client and Schreiterer Studio. If the shoot is canceled due to the Client’s illness or inability and it is not possible to reschedule the session, the initial deposit made will remain with Schreiterer Studio as compensation for the reservation of the date and the time dedicated to the planning.

26. Global and Enduring Application
All the terms and conditions established here are applicable worldwide, without geographical limitation, and do not have an expiration date. These terms and conditions will continue to be valid and binding on all parties, regardless of geographic location or the passage of time.
